Terms of Service
1. Who we are
Resift (the "App") and this website are provided by:
[FULL LEGAL NAME]
[STREET AND NUMBER],
[POSTAL CODE AND CITY], Switzerland
Email: hello@tryresift.com
By downloading or using Resift, you agree to these terms. If you obtained Resift through Apple's App Store, Apple's standard Licensed Application End User License Agreement also applies, and Apple is a third-party beneficiary of these terms.
2. What Resift is (and is not)
Resift is a personal capture-and-decide tool: you save short notes and ideas, and the App resurfaces them for a swipe decision. Resift is an organisational and productivity tool only — it does not provide medical, legal, financial, or other professional advice, and its suggestions (such as when to resurface an item or what a shopping "staple" is) are heuristics, not guarantees.
3. Licence
We grant you a personal, non-exclusive, non-transferable licence to use Resift on Apple-branded devices that you own or control, in accordance with the App Store terms. You may not copy, modify, distribute, sell, rent, reverse-engineer, or attempt to extract the source code of the App, except to the extent mandatory law permits it.
4. One-time unlock ("lifetime" licence)
Resift may offer a one-time purchase that unlocks additional features permanently ("lifetime unlock"). To be fair and precise about what "lifetime" means:
- It refers to the lifetime of the App as a product, not your lifetime or an unlimited period.
- It covers the App as it exists at the time of purchase, on platforms and OS versions the App then supports. We intend to keep improving Resift, but the unlock does not create an obligation to deliver specific future features or perpetual updates.
- We do not guarantee that the App will remain available forever. If we discontinue the App, purchases made through Apple remain governed by Apple's refund policies.
5. Billing, taxes, refunds — Apple
All purchases are made through Apple's App Store. Apple is the merchant of record and handles payment processing, VAT/sales taxes, and refunds under its own terms. We have no access to your payment details and cannot issue refunds directly; refund requests go through Apple (reportaproblem.apple.com).
6. Your content
Everything you save in Resift stays on your device (see the privacy policy). You retain all rights to your content. You are responsible for maintaining backups of your device; we cannot recover data stored only on hardware we never had access to.
7. Acceptable use
You agree not to use the App in violation of applicable law, to attempt to interfere with the App's operation, or to misrepresent your relationship with us.
8. Intellectual property
The App, its design, name, and logo are our intellectual property or used under licence. These terms grant you no rights in them other than the licence in section 3.
9. Availability and changes
The App is provided "as available." We may update, change, or discontinue features at any time. Where a change materially affects data handling, we will update the privacy policy first (see its section 10).
10. Warranty and liability
To the extent permitted by law, the App is provided without warranty of merchantability or fitness for a particular purpose. Our liability is excluded to the extent permissible under Swiss law; liability for unlawful intent or gross negligence (Art. 100 para. 1 of the Swiss Code of Obligations), and any liability that cannot be excluded by law (including for personal injury), remains unaffected.
Consumer rights: if you are a consumer, nothing in these terms limits mandatory rights you have under the law of your country of residence.
11. Termination
You can stop using Resift at any time by deleting the App. We may terminate the licence if you materially breach these terms. Sections that by their nature should survive (6, 8, 10, 12) survive termination.
12. Governing law and jurisdiction
These terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is [CITY OF DOMICILE], Switzerland — subject to any mandatory consumer forum in your country of residence.
13. Changes to these terms
We may update these terms; the current version is always published here with its "last updated" date. Material changes will be noted in the changelog.
